These terms apply to the services EverForge provides. Each project also has a written proposal or quote; if it conflicts with these terms, the proposal wins.
EverForge provides website development, business systems, AI implementation and lead generation services. The scope, deliverables, timeline and price of each project are set out in a written proposal that you accept before work starts.
We offer unlimited revisions before launch within the agreed scope. A revision is a change to work we've delivered, such as adjusting layout, copy or colors. New features, pages or functionality beyond the agreed scope are quoted separately. Changes after launch are covered by a care plan or quoted separately.
You agree to provide content, feedback, access and approvals in reasonable time, and confirm that you have the right to use any materials you give us (text, images, logos and data). Delays in providing these may move the timeline.
Once the project is paid in full, you own the final deliverables we create specifically for you, including designs, website code and your data. We keep ownership of our pre-existing tools, code libraries and know-how, and grant you a permanent license to use them as part of your deliverables. Third-party software and open-source components remain under their own licenses. We may show completed work in our portfolio unless you ask us not to.
AI tools can produce inaccurate or unexpected output. We configure AI systems with limits, approved sources and human handover where appropriate, but you remain responsible for how AI output is used in your business and for reviewing it where accuracy matters. AI services may depend on third-party providers whose pricing and availability can change.
Lead lists contain business contact information compiled from publicly available sources and verified at the time of delivery. Contact details change over time, so we can't guarantee that every record stays accurate. You are responsible for using lead data and running outreach in line with the laws that apply to you and your recipients (for example anti-spam and data protection rules), including honoring opt-out requests. We don't guarantee specific reply, meeting or sales results.
Where we host or maintain your project, we take reasonable steps to keep it secure, backed up and available, but we can't guarantee uninterrupted service from third-party infrastructure providers.
We keep your business information confidential and use it only to deliver our services. See our Privacy Policy for how we handle personal information.
To the extent the law allows, EverForge is not liable for indirect or consequential losses such as lost profits, revenue or data, and our total liability for any claim is limited to the fees you paid for the service in question in the [3 months] before the claim arose.
Either party may end a project with written notice. You pay for work completed up to that point, and we hand over the work you've paid for. See our refunds and cancellations page for details.
Our services must be used lawfully. See our Acceptable Use Policy, which forms part of these terms.
These terms are governed by the laws that apply where EverForge is established, and disputes will be handled by the courts of that place, unless mandatory consumer law gives you the right to bring a claim elsewhere.
